Welcome to What The Cluck Farms. These Terms of Service ("Terms") govern your use of our website and your purchase of products from us. By accessing our site or placing an order, you agree to these Terms. If you do not agree, please do not use our site or place an order.
1. Our Products
We sell pasture-raised poultry, beef, pork, and related farm products. Because we raise real food on a working farm, product availability, cut sizes, and weights vary naturally. Listed weights and prices are estimates; final pricing for weight-based items may be adjusted to reflect actual product weight at the time of fulfillment.
2. Orders and Acceptance
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order, limit quantities, or cancel an order at any time — including after it has been placed — due to product availability, errors in pricing or product information, or suspected fraud. If we cancel an order you have already paid for, we will refund the affected amount.
3. Pricing and Payment
All prices are listed in U.S. dollars. You agree to provide a valid payment method and authorize us to charge it for your order total, including any applicable taxes and delivery fees. We reserve the right to correct pricing errors even after an order is submitted.
4. Delivery and Your Responsibilities
Our products are delivered frozen. We do not provide dry ice, gel packs, or freezer packs, and we are not responsible for keeping your order frozen after delivery is completed.
If you will not be present to receive your delivery, it is your responsibility to leave out a cooler in a shaded location for us to place your order in. We are not responsible for product condition once an order has been delivered to the agreed location, including orders that thaw because no cooler was provided. Please refrigerate or freeze your products promptly after delivery.
5. Refunds and Replacements
We do not accept returns on perishable food products. Our satisfaction guarantee and replacement process are described in full in our Refund Policy, which is incorporated into these Terms by reference.
6. Food Safety and Use
You are responsible for handling, storing, cooking, and consuming our products safely and in accordance with safe food-handling practices. We are not liable for illness or injury resulting from improper storage, handling, or preparation after delivery.
7. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
8. Intellectual Property
All content on this site — including text, photos, logos, and product descriptions — is the property of What The Cluck Farms and may not be copied, reproduced, or used without our written permission.
9. Limitation of Liability
To the fullest extent permitted by law, What The Cluck Farms is not liable for any indirect, incidental, or consequential damages arising from your use of our site or products. Our total liability for any claim is limited to the amount you paid for the product at issue.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be handled in the courts located in [Leon County], Texas.
11. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted to this page. Your continued use of our site or purchase of products after changes are posted constitutes acceptance of the updated Terms.
